Release and Waiver of Liability

 

Waiver of Liability and Assumption of Risk Agreement

Carolina Soft Play Rentals LLC Waiver of Liability, Rules, and Safety Procedures Release and Waiver OF Liability is a legal document between the client "RENTER" and "CAROLINA SOFT PLAY RENTALS, LLC" this document affects your legal rights, so please read carefully.

 

The RENTER desires to rent equipment from CAROLINA SOFT PLAY RENTALS, LLC, to be used by the renter, his/her guests, invitees or other individuals while in RENTER's possession. RENTER understands that use of this soft play equipment may, by its nature cause injury or harm to renter, his/her guests, invitees or other individuals.

The RENTER does hereby freely, voluntarily, and without duress execute this release under the following terms:

  1. Waiver and Release: RENTER understands and acknowledges that this release discharges CAROLINA SOFT PLAY RENTALS, LLC from any liability or claim that the RENTER may have against CAROLINA SOFT PLAY RENTALS, LLC with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the RENTERs use and possession of CAROLINA SOFT PLAY RENTALS, LLC equipment. RENTER does hereby release and forever discharges and hold harmless CAROLINA SOFT PLAY RENTALS, LLC, its successors and assigns from any and all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from RENTER's possession and use of CAROLINA SOFT PLAY RENTALS, LLC equipment.

  2.  Insurance: Renter understands that insurance for liability, health, and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of the RENTER.

  3. Indemnification: RENTER agrees that he/she will indemnify and hold CAROLINA SOFT PLAY RENTALS, LLC harmless from any liability resulting from the use of CAROLINA SOFT PLAY RENTALS, LLC equipment by RENTER, his/hers assigns, heirs, guests, invitees or other individuals utilizing the equipment while in RENTER's possession.

 

By submitting a security deposit, the RENTER forfeits all rights to bring a suit against CAROLINA SOFT PLAY RENTALS, LLC for any reason. In return the RENTER will make every effort to obey safety precautions as listed in within, in efforts to keep the CAROLINA SOFT PLAY RENTALS experience positive. The RENTER agrees to have read the safety rules and understands that he/she should ask for clarifications when needed.

 

Safety Procedures/ Play Rules:

  1. PLAY AT YOUR OWN RISK

  2. ​Only children ages 6 and under are allowed in play area

  3. An adult (18 years old or older) must always watch and supervise the soft play equipment and its participants

  4. NO shoes, sneakers, flip flops, high heels, or sandals are allowed on mats or play area

  5. NO food, beverages, candy, or gum allowed in play area

  6. NO running is allowed in play area

  7. NO diving or throwing balls out of ball pit

  8. NO equipment should be removed from within play area

  9. NO shoving, pushing, wrestling, piling or rough play in play area

  10. ​NO glitter, slime, silly string, bubbles, messy art, temporary tattoos, face paint, or any other colored objects or chemicals are allowed in the play area or on the equipment

  11. All sharp objects must be removed before play including pens, pencils, jewelry, knives, eyeglasses, bling on pockets, etc.

  12. Do NOT enter if you are pregnant or have physical problems

  13. Do NOT move equipment once it is set up and keep all soft play equipment inside the play area.


The RENTER Understands that:

  1. I am responsible for following the rules and safe procedures mentioned above by CAROLINA SOFT PLAY RENTALS, LLC in order to protect the equipment and provide a safe environment for me, my guests and any other individuals who will have access to CAROLINA SOFT PLAY RENTALS, LLC equipment while it is in my possession.

  2. I AGREE TO RELEASE, DEFEND, INDEMNIFY, NOT SUE AND HOLD HARMLESS CAROLINA SOFT PLAY RENTALS, LLC, their principals, officers, owners, employees, and equipment manufacturers from any claims, damages, (including medical fees, attorney fees), injuries (including disabilities, paralysis and death) and expenses arising out of or resulting from my voluntary attendance/participation of CAROLINA SOFT PLAY RENTALS, LLC equipment.

  3. There is a REFUNDABLE SECURITY DEPOSIT, which can be in different amounts for particular items/packages. The security deposit is intended for last minute cancellations, damages, cleaning of equipment left in an extremely dirty condition, or the gathering of equipment that must be picked up from areas that we did not place them when delivered. This fee is non-negotiable if there is mud, food, candy, paint, liquid, sticky, non-removable or damaged equipment. Otherwise, please allow 3-5 business days for the deposit refund to be processed.

  4.  If there is any damaged or stolen soft play equipment, I will be charged and expected to pay an appropriate amount for the cost of repair or replacement of the item(s).

  5. Cancellations less than 14 days before the event will result in the loss of the $100 security deposit (ex: if my party is booked for 3pm EST on a Saturday, then I have until 3pm EST two Saturday’s prior to cancel without losing my deposit). We will allow for a reschedule up to 6 months from the original event date or it can be transferred to another person for a booking within that same 6 months timeframe.

  6. Event balance is due 7 days prior to the scheduled event date and time. If this balance is not paid by then, my event will be cancelled and security deposit will not be refunded. This booking is for up to four hours of play, anything after four hours will have an additional fee. Additional time can be added at time of booking. I am responsible for verbally notifying CAROLINA SOFT PLAY RENTALS, LLC at least 2 days before scheduled event end time if I need to add additional time. Additional time fee will be due at the time of notification, otherwise pick up will occur at the end of the original scheduled four hours.

  7. A fully shaded area or canopy is required for all outdoor set ups from May through August and must be in place prior to arrival otherwise I will rent a canopy/canopies from CAROLINA SOFT PLAY RENTALS. Some packages may require two canopies. 

  8. CAROLINA SOFT PLAY RENTALS will not set up outdoors after it has rained. At least twenty-four hours must pass before setup. For rain and inclement weather, CAROLINA SOFT PLAY RENTALS will reschedule up to 6 months from the original event date and if that’s not an option, they will refund minus the security deposit. NO EXCEPTIONS.

  9. There is a delivery fee of $1.55/mile which is calculated during booking. It is based on a round trip fare from Northlake Mall in Charlotte, NC, located at 6801 Northlake Mall Dr., Charlotte, NC 28216 using Google Maps.

  10. Prices are subject to change at any time. Booking minimum may be required for distance travel. Once deposit is paid my pricing is confirmed and secured.

  11. Operational hours are subject to change at any time.

  12. HOLIDAYS/HOLIDAY WEEKENDS are subject to a 30% surcharge on the package and/add on items.
